MOTOR VEHICLE ACCIDENTS

The right to recover damages suffered as a result of a motor vehicle accident in Ontario is governed by the Insurance Act.

Individuals injured in motor vehicle accidents must look to their own insurer for certain types of benefits including income replacement benefits, medical rehabilitation and housekeeping benefits.  If an individual’s injuries are serious enough and lead to an on-going impairment of important functions, the injured party is entitled to sue an at-fault driver for additional damages including damages for pain and suffering.

Determining what benefits an injured person is entitled to and whether those benefits flow from their own insurer or should be the subject matter of a lawsuit is a complicated matter.  Individuals should consult a lawyer to ensure they receive the maximum benefits they are entitled to and additional damages from an at-fault driver.

At SorbaraLaw, we have experience in handling actions involving motor vehicle claims including dealing with an individual’s own insurance companies, settlements of benefit entitlements and suing at-fault drivers.

We work hard to ensure you receive the benefits and compensation you are entitled to.

There are strict limitation periods for commencing motor vehicle actions and for making claims under an insurance policy.  It is important, therefore, that you consult a lawyer immediately if you have been involved in a motor vehicle accident.
