Our client was recently successful – following a seven-day trial in the Superior Court of Justice - in preventing the relocation of his son to North Bay, Ontario, from Waterloo Region. The Honourable Justice Piccoli’s 2023 decision in TW v JA illustrates the importance of complying with Ontario’s statutory relocation provisions prior to changing a child’s residence while also underscoring the primacy of the best interests of the child test in resolving cases involving parenting issues.
